City Attorney Dave Politte called the public hearing to order at 7:06 p.m.
At least 15 days’ notice of time and place of this public hearing was published in the Hermann Advertiser Courier newspaper.
The Exhibits to be entered into the record are as follows:
Exhibit 1) The Conditional Use Permit application for a business to have liquor sales for outdoor consumption in their private patio in the “C-2” Highway Commercial district for more than 12 operating days per year,
Exhibit 2) The Conditional Use Permit checklist attached to the application,
Exhibit 3) Photos of the area to be used for outdoor liquor consumption,
Exhibit 4) Affidavit of publication in the Advertiser-Courier newspaper,
Exhibit 5) Notice of Public Hearing published in the Advertiser-Courier newspaper,
Exhibit 6) Seating diagram of the area to be used,
Exhibit 7) Planning & Zoning Commission meeting minutes from the April 20, 2023 meeting recommending approval of the request,
Exhibit 8) list of neighbors within 185 feet of 112 East 5th Street,
Exhibit 9) The City of Hermann Municipal Code book. Mayor Bruce Cox accepted the exhibits into the record.
The hearing proceeded. City Clerk’s Note: Exhibits 3 and 6 of this hearing properly belong with the hearing for Seek Coffee Co./Katie & Craig Borcherding above. The Planning & Zoning Commission recommended approving the application submitted by TNKR, LLC/Trigg Render for a Conditional Use Permit for their business to have liquor sales for outdoor consumption in their private patio in the “C-2” Highway Commercial district for more than 12 operating days per year at their April 20, 2023 meeting.
Trigg Render presented his wish to expand seating to his outdoor patio at 112 East 5th . He said he will abide by the 35 person occupancy limit from the building inspector.
Public Comments – None. Alderwoman Susan Lenger moved to approve the Conditional Use Permit application submitted by TNKR, LLC/Trigg Render to have liquor sales for outdoor consumption in their private patio in the “C-2” Highway Commercial district for more than 12 operating days per year at 112 East 5 th Street. Second was given by Alderman Ash Geers. Mayor Bruce Cox called for a vote: Aldermen Geers, Lenger, LeRoy, and Schirmer ---aye NONE-----nay Motion passed unanimously. Public Hearing Concluded.
